This project was implemented from May to December 2003, through questionnaire and case study. It recorded and subsequently analyzed the process that different workers tried to protect their rights, studied different influence on workers' complaint by different ways, such as solving disputes by companies themselves, by administration, by law. According to the problems reflected by different cases, the project summarized the workers' complaint experience, developed teaching materials which is suitable for workers to protect their rights in the factories, and spread the materials to international brands and factories.
Executive Summary
In Recent years, the labor dispute cases increased largely with the economy development. Serious labor rights violation continuously happened, most of which were involved with the late payment and accidents of occupational safety and health. In 1999, there were 35000 labor dispute cases, in which 13000 cases were solved by labor arbitration, 18% of total cases in China. In most of the cases, the parties are migrant workers. More and more workers reflected that, it was very difficult to solve disputes by complaining to government department or by laws. They always faced the difficulties created purposely by some officials, the problems that government and some justice officials took sides of companies. They also cannot get social support when complaint occurred.
In order to reveal and overcome the barriers in the workers' complaint process, ICO is committed to perform tracing research on workers' complaint process. We interviewed over 600 migrant workers who were involved in labor dispute cases, and recorded their problems.
